TERMS OF USE - BUYERS

Preamble

Société Famille et Amis, whose registered office is located at 5 t avenue Foch, Saint-Mandé 94160, contact@cop-room.com, offers on its website www.cop-room.com of which it is the publisher, a service allowing adult buyers, after registration, to purchase the products offered in the catalog of the Website under the conditions established in the General Conditions of Sale of the Website that he accepts when placing his order, these being directly available on the Website. The Products offered on the Site are new products and are offered at a fixed price. By using the Service, the Buyer agrees to comply with these General Conditions of Sale without restriction or reservation. This acceptance is materialized by the action of the Buyer who checks a box attesting to his acceptance of these General Conditions of Use when registering to benefit from the Service.

Article 1 - Purpose of the General Conditions of Use:
The purpose of these General Terms of Use is to define the conditions under which the association Famille et Amis provides Buyers with technological tools enabling them to use the Service. In the event of non-compliance with these terms of use, or any use contrary to good faith, the Company "Famille et Amis" reserves the right to interrupt, temporarily or permanently, the Buyer's access to the Service. All of the clauses of these General Terms of Use are binding on the Buyer. The invalidity of a contractual clause does not entail the invalidity of the General Conditions of Use, unless this clause was decisive for the consent of one of the parties, either the Buyer or the seller taken in the legal entity of the Société Familiale des Amis, to conclude the sales contract resulting from the use of the Service in the context of the purchase of a Product. The spontaneous, temporary or permanent non-application by the Société Familiale des Amis of one or more clauses of the General Conditions of Use does not constitute a waiver of the other clauses of the General Conditions of Use which continue to produce their effects.


Article 2 - The Service
2.1 - Description of the Service
The Service consists of a set of technological tools allowing the Buyer to register on the Site, to place an order for a Product available in the Site's catalog, to pay the price of this Product, and to confirm receipt of this Product. The Service is not intended to allow the Buyer to resell his Product to the Company "Family and Friends". A contractual relationship between Family and Friends Society and the Buyer is linked by the sales transactions concluded after the Buyer's use of the Service.

2.2 - Access to the Service
The Buyer undertakes to access the Internet network in compliance with the law, in particular by concluding an Internet access supply contract with an access provider. The Buyer, by accepting these General Conditions of Use, acknowledges and agrees to engage in exclusively personal use of the Service. Use of the Service is subject to opening an account on the Site. This account is opened on a dedicated tab of the Site by providing the data allowing the Buyer to be identified and by creating a username and password freely determined by the latter. The Buyer undertakes to keep this username and password secret and not to disclose them to a third party and to ensure that the information transmitted is accurate. Access to and use of the Service via the Account are the sole responsibility of the Buyer, unless there is proof of fraudulent use of the Account. Where applicable, the Buyer may not be held liable for any use of the Service contrary to these Terms of Use and must immediately inform the Family and Friends Society association in the event of loss, misappropriation or fraudulent use of his/her username and/or password. In the event of modification of the information transmitted for opening the Account, the Buyer undertakes to modify this information, on his/her behalf, within a reasonable period of time.

2.3 - Price of the Service
The opening of the Account by the Buyer is free. The free nature is independent of any cost related to the Internet connection. No obligation to purchase is incumbent on the Buyer when using the Service. Only the actual purchase of a Product by the Buyer, after execution and validation of his order, obliges him to pay the price of the Product and this under the conditions defined in the General Conditions of Sale.

Article 3 - Personal data
Personal data concerning the Buyer are processed by Family and Friends Society, as publisher of the Site and responsible for processing this personal data. This personal data is necessary for the identification of the Buyer and for the proper use of the Service, in particular with regard to the delivery and payment of the Product and will only be used for this purpose. In accordance with the Data Protection Act, the Buyer has a right of access, rectification, a right to the portability of his personal data and a right to be forgotten. In order to assert his rights, the Buyer can contact the Family and Friends Society association at the following address: contact@cop-room.com.


Article 4 - Intellectual property
All documents, texts, descriptions, comments, images, illustrations, works and works reproduced or represented on the Site are protected by copyright as intellectual property for the duration of legal protection and for the entire world. Any reproduction, representation, modification or adaptation, in whole or in part, of the Site is strictly prohibited. All company names, brands and distinctive signs reproduced on the Site are protected under trademark and design law. The reproduction or representation of all or part of any of these signs is strictly prohibited and must be the subject of prior written authorization from the owner of the brand. As such, the use of the Service and, in general, the reading of all the documents referred to in Article 4 of the General Conditions of Use is reserved exclusively and strictly for personal and private use, subject to contrary or more restrictive provisions of the Intellectual Property Code.

Article 5 - Liability: It is understood that
Family and Friends Society cannot be held liable to the Buyer for acts that are not directly attributable to it and that do not cause any direct harm to the Buyer; - Family and Friends Society cannot be held liable for acts related to the Buyer's misuse of the Service or any fault on their part; - Finally, Family and Friends Society cannot be held liable for acts related to any act of misuse of the Service or fault attributable to a third party to the Service. In addition, pursuant to Law No. 2004-575 on confidence in the digital economy of June 21, 2004, the Société des Amis de la Famille cannot be held liable for the content made available on the Site by Buyers and Sellers, particularly with regard to comments and Product reviews, if, having been informed of the illegality of such content under the conditions provided for by the aforementioned law, the Société des Amis de la Famille Family has promptly made the disputed content inaccessible. In any event, the Buyer is solely responsible for his use of the Service.


Article 6 - Applicable law
These General Conditions of Use are subject to French law and apply to Buyers residing in a Member State of the European Union other than France, without prejudice to more favorable legislation in that State.

GENERAL CONDITIONS OF USE - SELLERS

Preamble

The Famille et Amis Company, whose head office is located at 5 t avenue Foch, Saint-Mandé 94160, inspired by the consignment model, offers on its website www.cop-room.com of which it is the publisher, a service allowing major sellers, after registration, to sell their products to the Famille et Amis Company, owner of the Site, so that the latter offers the Products in the Site catalog, with a view to their sale under the conditions provided for in the General Conditions of the Site. The Products offered for sale by the Seller are new products and are offered at a fixed price. By using the Service, the Seller agrees to comply with these General Conditions of Use without restriction or reservation. This acceptance is materialized by the action of the Seller who checks a box attesting to his acceptance of these Conditions of Use when registering to benefit from the Service.


Article 1 - Purpose of the General Conditions of Use
The purpose of these General Terms of Use is to define the conditions under which the Société Familiale et des Amis provides the Seller with technological tools enabling it to offer its Product for sale to the Société Familiale et des Amis. In the event of non-compliance with these General Terms of Use, or any use contrary to good faith, the Société de la Famille et desAmis reserves the right to interrupt, temporarily or permanently, access to the Seller's Service. Article 2 - The Service
2.1 - Description of the Service
The Service consists of a set of technological tools allowing Sellers to register on the Site, to offer a Product corresponding to those offered by Family and Friends Society on its Site, to choose a sales method according to the options envisaged in the General Conditions of Sale of the Site, to sell the Product and to choose the terms of delivery of this Product to Family and Friends Society. A contractual relationship between the Society for Family and Friends and the Seller is thus established by the sales transactions concluded at the end of the use of the Service by the Seller.

2.2 - Access to the Service
The Seller undertakes to access the Internet in accordance with the law, in particular by concluding a contract for the provision of Internet access with an Internet access provider. The Seller, by accepting these General Conditions of Use, acknowledges and agrees to engage in exclusively personal use of the Service. Use of the Service is subject to opening an account on the Site. This Account is opened on a dedicated tab on the Site by providing the data allowing the Seller to be identified and by creating a username and password freely determined by the Seller. The Seller undertakes to keep this username and password secret and not to disclose them to a third party and to ensure that the information provided is accurate. Access to and use of the Service through the Account are the responsibility of the Seller, unless there is proof of fraudulent use. Where applicable, the Seller shall not be held liable for any use of the Service contrary to these General Terms of Use and shall immediately inform Family and Friends Society in the event of loss, misappropriation or fraudulent use of its identifier and/or password. In the event of modification of the information transmitted for the opening of the Account, the Seller undertakes to modify this information, on its behalf, within a reasonable period of time.

2.3 - Price of the Service
The opening of the Account by the Seller is free. The free service is independent of any cost related to the Internet connection. The use of the Service by the Seller is not subject to any obligation to sell. Only the effective sale of a Product by the Seller, subject to the agreement of the Société des Amis de la Famille, requires the provision and supply of the Product to the Société des Amis de la Famille under the conditions provided for in the General Terms and Conditions of Sale.


Article 3 - Personal data
Any personal data concerning the Seller is processed by Family and Friends Society, in its capacity as publisher of the Site and responsible for processing this personal data. This personal data is necessary for the identification of the Seller and for the proper use of the Service, in particular with regard to the delivery and payment of the Product and will only be used for this purpose. In accordance with the Data Protection Act, the User has a right of access, rectification, a right to the portability of his personal data and a right to be forgotten. In order to exercise his rights, the User can contact the Family and Friends Society association at the following address: contact@cop-room.com.


Article 4 - Intellectual property

- The liability of the Family and Friends Association towards the Seller cannot be incurred for facts which are not directly attributable to it and which do not cause any direct damage to the Seller; and
- The liability of the Family and Friends Association cannot be incurred for facts linked to the misuse of the Service by the Seller or to any fault on its part; and
- The liability of the Family and Friends Association cannot finally be incurred due to facts related to any fact of misuse of the Service or fault attributable to a third party to the Service. In addition, in application of law n° 2004-575 for confidence in the digital economy of June 21, 2004, the liability of the Family Company cannot be incurred due to the content made available on the Site by Buyers or Sellers and in particular with regard to comments, appreciations of the Products if, having been informed of the illegality of this content under the conditions provided for by the aforementioned law, the Family Company has promptly made the disputed content inaccessible. In any event, the Seller is solely responsible for the use he makes of the Service.


Article 6 - Applicable law
These General Conditions of Use are subject to French law and apply to Sellers residing in a Member State of the European Union other than France, without prejudice to more favorable legislation in that State.
